What do these bills do exactly?
SB 211 is titled “relative to biological sex in student athletics” but it’s also known as "Protection of Women's Sports Act." This retained bill is nearly identical to HB1205, which codified discrimination against trans athletes in high school, but it extends that discrimination against trans athletes in college. This bill seeks to specifically target trans women and girls who wish to play on female gendered teams under the veil of “protecting girls.” Additionally, it creates a dangerous and invasive policy using “biological sex” as a determining factor.
SB 268 is titled “permitting classification of individuals based on biological sex under certain limited circumstances.” Retained from last year, this bill legalizes discrimination for bathrooms, locker rooms, sports, and prisons on the basis of "biological sex" as defined as only "male" and "female,” completely erasing the scientific reality of intersex individuals. This bill is very similar to HB 148, which was passed last year by both the House and the Senate, but vetoed by the Governor, and failed to achieve a super majority to overturn the Governor’s veto largely because it’s unenforceable in its very nature.
SB 33 is titled “relative to the regulation of public school materials, or commonly referred to as the "Right To Challenge Act." Retained from last year, this bill enables small groups of citizens to designate what materials are considered "harmful" within a public school, and potentially cause their removal for all. This bill opens up the possibility for district-wide censorship of LGBTQIA+ materials.
