What the bill does:

Right now, massive data centers can begin drawing enormous amounts of electricity from the grid without any upfront review of the costs or risks to Virginians. This is triggering the build-out of expensive new power plants and grid infrastructure, for which all Virginians are paying.

HB155/SB619 closes a regulatory gap by requiring new high-load facilities, including data centers, to obtain a certificate of operation from the State Corporation Commission (SCC) before they connect to the grid.

The SCC can only approve these facilities if it finds they meet the following criteria:

  • No material harm to utility customer bills

  • No threat to grid reliability

  • No harm to the utility's ability to meet clean energy policy deadlines

  • Alignment with the public interest
