We have an urgent call to action regarding Big Oil’s attempt to escape accountability via the Supreme Court. Can you email your democratic representatives and senators and ask them to stand in solidarity with communities seeking climate accountability, like Boulder, by signing on to the amicus brief (info below)? Deadline for members to sign is Friday, 7/24 at 10am.

Background:

This fall, the Supreme Court will consider a case brought by the City and County of Boulder, Colorado, which is seeking to hold Exxon and Suncor accountable for knowingly contributing to the climate crisis. Boulder’s lawsuit, like several others brought by communities across the U.S., is advancing toward discovery and trial after Colorado courts denied Big Oil’s attempts to dismiss the case.

The Supreme Court will consider two questions: (1) whether federal law preempts state law claims seeking relief for damages caused by global greenhouse gas emissions; and (2) whether the court even has jurisdiction to hear this case at all. SCOTUS’s review will ultimately determine whether Boulder’s case against ExxonMobil and Suncor can proceed, which may have major implications for similar lawsuits across the country.

In response, Senator Sheldon Whitehouse and Representative Pramila Jayapal are organizing a congressional amicus brief in support of Boulder’s lawsuit.

Urgent request:

Over the past six months, you have helped build a nationwide campaign to ensure that Big Oil answers for their contributions to the climate crisis. This is yet another bad faith strategy from the fossil fuel industry to escape accountability and the time to act is now.

Will you reach out to your members of Congress and kindly ask them to sign on to the amicus brief by Friday, July 24, 10am ET?
