Governor Whitmer: Bring Demetrius Frazier Back to Michigan!

BACKGROUND:

Demetrius Frazier, sentenced to death in Alabama for a crime that occurred when he was 19 years old, will be executed by gas suffocation in Alabama on February 6, 2025 unless Michigan Governor Gretchen Whitmer orders the Michigan Department of Corrections (MDOC) to return Mr. Frazier to Michigan to serve out his three life sentences.

Former Michigan Governor Snyder entered into an unlawful agreement to transfer Mr. Frazier to Alabama and current Michigan Governor Whitmer has done nothing to fix it.

Mr. Frazier filed this lawsuit against both Warden Terry Raybon (his statutory executioner) and Heidi Washington, Director of the Michigan Department of Corrections, alleging his presence in Alabama is illegal. The legal action is paused because Michigan's Attorney General filed a response refusing to seek Demetrius's return to Michigan. Unless Governor Whitmer signs an executive order seeking his return, Demetrius will be suffocated to death on Feb. 6, becoming the first Michigan prisoner to be executed in 180+ years!

Demetrius Frazier was serving three life sentences when he was wrongly transferred to Alabama by former Governor Snyder, where he faces execution by gas suffocation on February 6, 2025. Mr. Frazier is technically under the custody of the Michigan Department of Corrections, which lists his location as Alabama.

The State of Michigan abolished the death penalty in 1847, and constitutionally prohibited it in 1963. Human rights norms prohibit the transfer of prisoners to other jurisdictions where they may suffer punishment that is disallowed in the originating jurisdiction.

I acknowledge that Mr. Frazier has committed serious crimes for which he must be held accountable. Michigan has in place the mechanisms to do so without violating the Michigan State Constitution.
