CPV, Competitive Power Ventures, is the biggest fracked gas climate criminal you've never heard of. They built a 650 MW fracked gas-power plant in Orange County New York that could never have been permitted without the bribery scheme that landed a company executive and state official in jail. It was built in a critical environmental area, on protected wetlands, endangered species habitat, over a Sole Source Aquifer on a historic farm in a special agricultural district, and over a Native American burial ground. Despite the criminal convictions the plant became operational in 2018 under former Governor Cuomo. This resulted in a 10% increase in downstate New York's Greenhouse Gas emissions. However they never received a Federal Clean Air Act permit. In 2019 the NYSDEC rejected the permit, but the company appealed the decision and has been allowed to operate ever since. Now after 6 years the State Department of Environmental Conservation will make a final determination whether to let this plant continue operating or to order it to cease operations. Please help us tell Governor Kathy Hochul, DEC Commissioner Sean Mahar, Senator James Skoufis, and Assemblyman Karl Brabanec that the CPV Valley plant must be shut down once and for all. It's time to shut down the CPV Valley fracked gas power plant once and for all. CPV is a threat to public health and safety, a threat to the climate, and a threat to integrity and faith in government. It was built on bribes and lies. The criminal conviction of Joseph Percoco and Peter Braith Kelly along with the investigation of the Senate Government Oversight Committee clearly establishes the improper influence the company exerted on local and state officials.
CPV is inconsistent with New York State's Climate and Community Protection goals. It has increased downstate New York's greenhouse gas emissions by 10%.
The plant is inconsistent with New York State's environmental declarations. The State banned High-Volume Hydraulic Fracturing recognizing its adverse public health and climate impacts. But CPV depends on over 150 fracking wells per a year. Allowing it to operate created all the same adverse impacts from the well-heads in Pennsylvania, all along the Millennium Pipeline, through the Minisink Compressor Station and finally at the power plant itself.
The siting of the plant by the Town of Wawayanda is an act of environmental racism. The plant's operations violate federal and state environmental justice laws that protect Disadvantaged Communities. There are over 34 PEJA/DAC communities within 5 miles of the plant, which are now being poisoned by over 700 tons of toxic air pollutants and 2.1 million tons of CO2 annually, (along with all people, pets and wildlife near it); These emissions are well-known to cause numerous health impacts including asthma, cancer, heart disease, and learning disabilities. CPV's scheme to donate a million dollars in order to continue poisoning the thousands of children who live near it, is insulting and must be rejected.
CPV is a monument to corruption. If this permit is not rejected, you will be rewarding corruption, and inviting other predatory companies to evade the laws and abuse the citizens of this great state.
We demand that you reject the final Title V and Title IV permits, and pull the plug on CPV.
