A bill that would criminalize health care for transgender youth just passed out of a key House committee in the South Dakota Legislature.
HB 1057 would prohibit health care professionals from providing crucial gender affirming medical care to minors, even making this a crime—a Class 1 misdemeanor. The penalty for a Class 1 misdemeanor is one year in jail and a maximum fine of $2,000.
HB 1057 is part of a wave of bills that Republicans are using to target transgender youth across the nation. Similar bills have already been introduced in South Carolina, Colorado, Florida, Oklahoma and Missouri. Republicans in several other states have announced their intention to follow suit.
Transgender youth should be the only ones making decisions about their health in consultation with their physicians and their families.
This restriction flies in the face of best medical practices for transgender care. Medical professionals seeking to help young trans patients would risk losing their license for following their Hippocratic Oath.
By barring access to gender affirming treatments, the South Dakota Legislature would put the health and safety of trans youth at risk.
Access to gender affirming doctors and care reduces the risks of depression, self-harm, and suicidal behavior for trans youth. Trans youth deserve to be seen, accepted, and affirmed in who they are.
House Bill 1057 does nothing to protect children in South Dakota. This bill serves to criminalize trans people’s health care and punish doctors and parents supporting trans children. HB 1057 is just another attempt to control individuals' bodies based on the anatomy they’re born with.
