While the electoral vote in the 2020 presidential election was close, Joe Biden won the national popular vote by a decisive margin of 7 million votes. In fact, his popular vote win well exceeded Hillary Clinton's popular vote win over Donald Trump in 2016.
Sadly, however, in United States presidential elections the candidate who receives the most votes does not always win. If so, HIllary Clinton & Al Gore would have been elected president. Instead of the simplicity and democracy of "one person, one vote," our electoral system is convoluted and all too often results in an undemocratic outcome.
Fortunately, there is a solution to this problem that does not require a constitutional amendment.
An effort known asThe National Popular Vote Interstate Compact (NPVIC) is an agreement among several U.S. states and the District of Columbia to award all their respective electoral votes to whichever presidential candidate wins the overall popular vote. Once states totaling 270 electoral votes join the compact—which only requires passing state laws—then the next presidential election will be determined by the popular vote, not the Electoral College. (Notably, the NPVIC does not go into effect until states totaling 270 or more electoral votes have joined it.)
As of late 2020, fifteen states and the District of Columbia have signed the compact, totaling 196 electoral votes. So, we are already 72% of the way there. If we can make this a national issue now—and encourage state legislatures across the country to sign the compact—the winner of the 2024 presidential election could be determined by popular vote.
We live in a democracy, and the presidential candidate who receives the most votes should win. Further, all votes should count the same no matter who you voted for and no matter whether you live in a swing state or not.
