Did you know there is a way to elect the president by national popular vote without an amendment to the Constitution? It's called the National Popular Vote Interstate Compact (NPVIC), and it might take another step toward becoming reality if the Virginia state legislature acts on it in the coming weeks.

The National Popular Vote Interstate Compact is a legally binding agreement between states to award their electoral votes to the winner of the national popular vote. It is passed through state laws, not federal laws or constitutional amendments. Interstate compacts are 100% constitutional, and over 250 of them are active today. The agreement only goes into effect once states totaling 270 or more electoral votes have joined the compact by July 1 in the year of the next presidential election. Right now, that means by July 1, 2028.

As of this writing, states totaling 209 electoral votes have joined the compact, meaning that states totaling 61 additional electoral votes are needed in order for it to go into effect and for the next presidential election to be decided by the national popular vote.

Virginia, which has 13 electoral votes, is one of the states that has not yet joined the compact, but might do so soon. Now that the state has a Democratic governor and Democratic majorities in both branches of its state legislature, 2026 could be the year when it happens.

Back on February 3, 2026, a bill to have Virginia join the National Popular Vote Interstate Compact passed the state Senate Privileges & Elections committee (note: I received this information from allies working on the issue in the state). There is also a companion bill in the Virginia state House, which has a large Democratic majority.

At this point, the largest obstacle to Virginia joining the NPVIC is not one of votes, but is instead a matter of time and priorities. The state legislature will wrap up its work for the year around mid-March, and there are many other important, competing pieces of legislation that they are looking to pass. However, we need to urge them to make joining the NPVIC enough of a priority that they do it this year.
