Dear Hayward Residents,
A massive data center is being built at 26062 Eden Landing Road — 310,000 square feet, 76.6 megawatts of capacity (enough to power roughly 76,000 homes), and 28 diesel backup generators, sited close to our neighborhoods and the Eden Landing shoreline.
Here's the part that should concern everyone: this project was approved by the Planning Commission in 2025 without a single City Council vote, through a zoning loophole. The City has since admitted the process was flawed and rewrote its own rules so that any future data center over 50 MW must go before the elected Council. SVY03A is well over that threshold — but it already got through under the old rules.
We're asking the City Council, the California Energy Commission, and State Senator Aisha Wahab to require a full environmental review, a public Council hearing, and real transparency about the water and power this facility will use — before any further permits or expansions are approved.

We, the undersigned residents of Hayward, call on the Hayward City Council and the California Energy Commission to require a full Environmental Impact Report (EIR) for the STACK Infrastructure SVY03A Data Center Campus at 26062 Eden Landing Road — replacing the lighter-weight Mitigated Negative Declaration (MND) currently relied on — before any further permits, expansions, or generator installations are approved.
An environmental review was already conducted, but not the right kind. Because STACK
sought a Small Power Plant Exemption, the California Energy Commission (not the City) served as CEQA lead agency and prepared a Mitigated Negative Declaration — a streamlined review used only when a project's impacts can be reduced to insignificance through mitigation. The CEC adopted that MND and granted the exemption in May 2025. A full Environmental Impact Report is the more rigorous CEQA process, required when there is substantial evidence a project could have significant impacts — it demands genuine alternatives analysis and a full accounting of cumulative effects, not just a mitigation checklist. Given this project's scale, we believe it warrants that higher bar, and we are not alone: a local conservation group formally urged the CEC to require an EIR instead of an MND during the 2025 comment period, a request the Commission did not adopt.
Separately, the Hayward Planning Commission approved this 310,000-square-foot facility in
May 2025 without ever bringing it before the elected City Council — a decision made possible only by a zoning loophole the City has since admitted was a mistake by rewriting its own rules to require Council review for any future data center over 50 megawatts. SVY03A itself, at 76.6 megawatts, would never be approved administratively under the City's own new standard. We believe the same scrutiny should apply retroactively to this project's remaining permits and any future expansion.
Our concerns:
1. Water: Industrial-scale cooling demand in a region already facing water stress, with no public accounting of the facility's draw on local supply.
2. Power grid strain: Electrical capacity equivalent to powering roughly 76,000 homes, drawn by a single private facility.
3. Diesel emissions: 28 backup diesel generators sited near residential neighborhoods and the Eden Landing shoreline/estuary, with real air quality consequences.
4. Noise, heat, and traffic from 24/7 industrial operation in a community setting.
5. Process: Approval granted with minimal public notice and no City Council vote on a project of this scale.
We are asking for:
1. A full, independent Environmental Impact Report before any further permits, expansions, or generator installations are approved.
2. A public City Council hearing and vote on SVY03A's remaining approvals, consistent with the City's own new 50 MW threshold rule.
3. Public disclosure of the facility's projected water and electricity consumption.
4. A ban on new hyperscale data center approvals in Hayward until updated zoning and environmental safeguards are in place.
