We know that the Constitution requires the President to make a Supreme Court nomination. Then, the Senate needs to provide a hearing or an up-or-down vote on that nominee. History teaches us that every Supreme Court nominee has received a vote or a hearing since Ulysses S. Grant was President.
And now, in the same week we're celebrating the 62nd anniversary of Brown v. Board of Education, we find ourselves trying to explain to our students why Senator Portman and his colleagues refuse to do their jobs and support a hearing or vote on Judge Garland's nomination to the U.S. Supreme Court. These partisan political games are absurd and dangerous.
