Section 404 of the Clean Water Act requires authorization from the Secretary of the Army, acting through the Corps of Engineers, for the discharge of dredged or fill material into all waters of the United States, including wetlands. A Corps permit is required, whether the work is permanent or temporary.

The Section 404 authorization is the last outstanding permit that Mountain Valley needs to begin construction on the MVP Southgate Expansion, and they expect it by the end of February. The time is NOW to reinforce to the Army Corps of Engineers that the public DOES NOT support this dirty, dangerous, unnecessary project. For years MVP Southgate—a proposed extension of MVP mainline—has never moved forward and has been denied multiple permits. Community members along the MVP mainline route tell us how their lives, their land and their waterways continue to suffer as a result of these pipeline developers, their violations and the lack of accountabilty.

Approval of MVP Southgate raises serious concerns for Indigenous communities, frontline neighborhoods, and the lands and waters that sustain them. This pipeline threatens ancestral territories, cultural landscapes, and communities already facing disproportionate health and environmental burdens. Our communities have said no—clearly, repeatedly, and collectively—and we will continue to resist the sacrifice of our lands and lives for fossil fuel expansion.
