Dear Secretary Rubio and Secretary Mullin,
We write to urge you to take immediate action to suspend deportations to Venezuela and reinstate Temporary Protected Status (TPS) for eligible Venezuelan nationals in light of the unprecedented humanitarian catastrophe now unfolding in the country.
Venezuela is experiencing the most devastating earthquake in more than a century. Entire communities have been reduced to rubble, rescue operations are overwhelmed, hospitals are operating beyond capacity, and critical infrastructure has been severely damaged. Millions of people are struggling to survive amid continuing aftershocks and a rapidly worsening humanitarian emergency. At this moment, Venezuela is fighting to save lives—not receive deportation flights.
Despite these extraordinary conditions, the United States continues to deport Venezuelan nationals into the midst of this disaster.
Hours before the first major earthquakes struck, the United States deported more than 160 Venezuelans to their home country. According to reporting by the Associated Press, more than 100 of those deportees were staying in a hotel that was destroyed during the earthquake and remain missing. This tragedy underscores the grave risks of returning individuals to a nation experiencing an active humanitarian and natural disaster.
Every deportation flight sent to Venezuela under these conditions places human lives in jeopardy. No person should be forced into an active disaster zone where access to shelter, medical care, clean water, food, and basic public safety cannot be assured.
Congress established Temporary Protected Status precisely for circumstances such as these. TPS authorizes protection for foreign nationals when their home country is experiencing an environmental disaster, armed conflict, or other extraordinary and temporary conditions that make safe return impossible. The conditions in Venezuela clearly warrant the exercise of that humanitarian authority.
Continuing deportations while Venezuela struggles through this catastrophic emergency is inconsistent with the humanitarian purpose of U.S. immigration law. Every removal carried out under these circumstances unnecessarily increases the risk to human life.
Accordingly, we respectfully urge you to:
- Immediately suspend all deportation flights to Venezuela;
- Re-designate Temporary Protected Status for eligible Venezuelan nationals without delay; and
- Ensure that no individual is returned to conditions that threaten their life, health, or safety while this humanitarian emergency persists.
The decisions made in the coming days will have profound and lasting consequences. Your departments possess the legal authority and the humanitarian responsibility to act swiftly in order to prevent further loss of life.
We respectfully ask that you exercise that authority immediately by halting deportations to Venezuela and restoring Temporary Protected Status for eligible Venezuelans.
