We are writing to formally request that you, in your role as a member of the Investment Advisory Panel and /or Joint Advisory Group for the West Yorkshire Pension Fund (WYPF), advocate that the Investment Advisory Panel, the Joint Advisory Group and the WYPF as a whole should adopt and implement a policy of divestment from all companies which have contracts, investments, business dealings, or official connections of any kind, with individuals or companies involved in the illegally Occupied Palestinian Territories.

We are asking that you, as a member of the Investment Advisory Panel/Joint Advisory Group of the WYPF, adopt this policy under the terms of the WYPF’s Social, Environmental and Governance (SEG) policy, which is contained in the WYPF’s Investment Strategy Statement (ISS).

Using Freedom Of Information (FOI) requests, the Palestine Solidarity Campaign (PSC) has identified a list of 34 companies which the WYPF invests in, that are involved in the Occupied Palestinian Territories of East Jerusalem, the Gaza Strip and the West Bank. This involvement includes: supplying weapons and military
technology to Israel; building infrastructure, such as roads in illegally occupied Palestinian lands; conducting business activity in, or with, Israel’s illegal settlements; and thereby contributing both to human rights violations against Palestinians and to Israel’s illegal occupation.

The total amount invested by the WYPF in these companies is over £995 million. (see Appendix 1)

This list includes:

BAE Systems Ltd supplies arms and military technology to Israel, including 15 per cent of each F-35 warplane used by Israel in its war on Gaza. Israel has 39 F-35s, with a further 36 on order. Israel has used these aircraft, equipped with US-made 2000lb bombs, in some of the most devastating attacks. On 2 September 2024, the very day the UK Government announced it was suspending around 30 arms export licences to Israel, Danish NGO Danwatch revealed that an F-35 was used in July to drop three 2000lb bombs in an attack on a so-called “safe zone” on Al-Mawasi in Khan Younis, killing 90 people (see Appendix 2).

The WYPF had over £90 million invested in BAE, as of March 2024.

Barclays Bank as of February 2024, holds over £2 billion of shares in, and provides £6.1 billion in loans and underwriting to, 9 companies whose weapons, components and military technology are being used by Israel in its attacks on Palestinians in the Occupied Palestinian Territories (see Appendix 3).
By providing investment and financial services to these arms companies, Barclays is facilitating the provision of weapons and technology for Israel’s attacks on Palestinians. In addition, Barclays has an agreement with Israel to act as a ‘primary dealer’ for its government bonds. This means it helps Israel directly to raise money
to fund its genocide and apartheid against Palestinians.

The WYPF had over £107 million invested in Barclays Bank, as of March 2024.

Caterpillar supplies Israel with D9 bulldozers that are used to demolish the homes of Palestinians and build illegal settlements in the Occupied West Bank, and which have been used to demolish whole swathes of Palestinian homes and civilian infrastructure, including hospitals, in Gaza. For instance, D9 bulldozers were used by the IDF in March 2024 to demolish Al-Shifa hospital in Gaza City.

The WYPF had over £17 million invested in Caterpillar, as of March 2024.

HSBC is a major shareholder in companies supplying weapons to Israel, and provides arms companies with the loans and other financial services they need to operate. They also have £100 million worth of shares in Caterpillar.

The WYPF had over £220 million invested in HSBC, as of March 2024.

In January 2024, the International Court of Justice (ICJ) stated that Israel’s actions in the Gaza Strip justify further investigation and that it is plausible that those actions could amount to genocide. In September the UK Government decided to suspend 30 arms export licences due to concerns about Israel’s treatment of Palestinian prisoners, restrictions on the supply of humanitarian aid, and conduct of the war in Gaza, including the wide-scale destruction of houses, indicating a clear risk of a serious breach of international humanitarian law. In November 2024, the International Criminal Court (ICC) issued arrest warrants for Benjamin Netanyahu and Yoav Gallant for the war crime of starvation as a method of warfare and the crimes against humanity of murder, persecution, and other inhumane acts.

Crucially, in July 2024, in response to a request the UN General Assembly made in December 2022, the ICJ published its Advisory Opinion on the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territories, including East Jerusalem.

This states:

Israel’s presence in the Occupied Palestinian Territories is illegal

Israel is obliged to end the Occupation as rapidly as possible

Israel must immediately cease all new Settlement building, and evacuate all settlers from the Occupied Palestinian Territories

Israel must make reparations for damage caused in the Occupied Palestinian Territories

All states are obliged not to recognise the Occupation as legal

All states are obliged not to aid or assist Israel in maintaining the Occupation The ICJ also found that:

Israel’s treatment of Palestinians amounts to discrimination on grounds of race, religion or ethnic origin

Israel’s policies and practices have denied the Palestinians their right to self-determination, and that continuing these would undermine the exercise of this right in future

This ICJ Advisory Opinion should leave all companies, and all pension schemes, in absolutely no doubt that business interests involving the Occupied Palestinian Territories are at significant risk of contributing to these Human Rights abuses. In turn, this would qualify as ‘professional misconduct’ by such companies, and so provide legitimate grounds for pension schemes to divest from them.

Not only that, the existing UK Government policy as spelled out in Overseas business risk: The Occupied Palestinian Territories (February 2022), is clear that Israel’s “…Settlements are illegal under international law”, and then goes on to state, specifically:

“There are therefore clear risks related to economic and financial activities in the settlements, and we do not encourage or offer support to such activity. Financial transactions, investments, purchases, procurements as well as other economic activities (including in services like tourism) in Israeli settlements or benefiting Israeli settlements, entail legal and economic risks stemming from the fact that the Israeli settlements, according to international law, are built on occupied land and are not recognised as a legitimate part of Israel’s territory….”

We believe that investing in, or having business dealings with companies involved in the Occupied Palestinian Territories constitutes ‘professional misconduct’, which is grounds for divestment.

We also believe that investments in and business dealings with such companies constitute significant investment risks, considering the illegal status of the Israeli settlements. Therefore we consider that it would be fully in line with the fiduciary duty which the WYPF has towards the members of the Fund, for the WYPF to adopt and implement a policy of divestment from any companies involved in, or with connections to those involve in, Israel’s illegal settlements in the Occupied Palestinian Territories.

Finally, we would like to request that you reply formally in response to our request in this Open Letter, in order to inform us whether you will (or will not) support, and also advocate for the WYPF to adopt and implement, this divestment policy.
