Protect Pay Transparency in Washington
Washington State lawmakers are considering three bills that will transform our state’s current effective pay transparency laws into nothing more than an illusion.
How HB 2377, SB 6100, & SB 6221 Weaken Pay Transparency Protections:
• Rewards bad actors while offering no benefit to compliant employers
These bills create loopholes that allow employers who violate the law, including repeat offenders, to avoid meaningful consequences, while employers who already follow the rules gain nothing.
• Discourages workers from reporting violations
Workers would be required to notify employers of violations and wait for correction before enforcement can occur, putting the burden on workers and increasing fear of retaliation.
• Puts workers on trial instead of non-compliant employers
Employers would be allowed to argue that workers who report violations were not “serious” job applicants, forcing courts to examine a worker’s intent rather than whether the employer broke the law.
• Weakens broader worker protections statewide
Taken together, these bills shift power away from workers and toward employer discretion, reducing workers’ ability to challenge inequities, even when violations are clear.
