In a historic decision, the National Labor Relations Board (NLRB) has ruled that Color Of Change—one of the nation's largest racial justice nonprofits—violated federal labor law by unlawfully laying off 54 employees without bargaining.
These workers, who unionized with the Washington-Baltimore News Guild in October 2020, were entitled to negotiation rights before any layoffs could occur. Yet Color Of Change, represented by Seyfarth Shaw, disregarded these obligations and illegally laid workers off. The NLRB has now made it clear that these layoffs were illegal and ordered the organization to reinstate the workers and pay back wages and benefits with interest.
