State Legislators Considering Executions to Punish Abortion

In a growing trend started several years ago, state legislators are proposing the death penalty as a judicial sanction for people who have an abortion, provide an abortion, or in some way support such individuals. As of this writing (Feb 21, 2026), legislators in Tennessee, Indiana, North Dakota, Oklahoma and South Carolina have done so in recent times. This string of human rights abominations constitute the most recent example of how when we give our government the power to murder its prisoners, we open a Pandora’s Box to state killings that endangers us all.

If these bills become law, it could be possible that a physician can be charged with capital murder and sentenced to death if he or she provides a planned abortion, and depending on the proposed legislation, so can the woman receiving an abortion, or even those who support them. If they don't get a death sentence, the punishment could be an automatic Life Without the Possibility of Parole sentence.

To be clear, Death Penalty Action takes no position on abortion or life issues other than judicial executions by governments. Still, these callous and extreme bills go way too far by opening the door to the possibility of death sentences and executions for women who have an abortion and those who provide them. We believe such bills are understood to be unconstitutional and will not be enacted, and are being used to rile up anti-abortion extremists. This is inappropriate and must be opposed.

While some of us may support or oppose the legality of abortion, we oppose the idea that anyone should be charged with a capital offense or executed as a result of providing or seeking an abortion. Please defeat any legislation proposing such extreme measures.
